BASI Systems Studio Rental This Studio Rental Agreement is made by and between Springbell Pilates Studio ("the Company") and the Tenant referred to individually as "Party" and collectively as "Parties." For good and valuable consideration, the sufficiency of which is acknowledged, the Parties agree as follows: Studio Rental. The Company agrees to rent to the Tenant, and the Tenant agrees to rent from the Company according to the terms and conditions set forth herein, the following space: a studio and related facilities ("the Studio"), to be used for the purpose described as chosen by the Tenant. Purpose of Use. The Tenant agrees to rent and use the Studio for the following purposes, either for self-practice or teaching. Terms & Conditions: Booking Policy: For each teaching hour, the Instructor can only bring maximum 1 practice body. For each self-practice hour, the Instructor is not allowed to bring any third parties and/or any outsiders to the Studio without prior notice. All bookings must be made via WhatsApp at 017-7201353 with the following details:- Instructor’s & Clients’ Indemnity Forms, Date & Time, Private Room / Teaching Spot / Self-Practice Spot. All reservation is only confirmed upon the receipt of the payment. Please send us the payment details at WhatsApp for our confirmation. Declaration of Identity for Studio Rental: The Tenant shall disclose if he/she is the owner, employee, or affiliate of another Pilates and/or fitness studio prior to the reservation and/or booking. The Tenant shall fill up the google form provided by the Company, disclose the name of the practice body and furnish the Company all necessary indemnity and risk and waiver of liability forms. Failure to disclose and/or using other names to rent/use the Studio may result in immediate cancellation of the rental without refund. Non-Solicitation: The Tenant is prohibited from the following:- Directly or indirectly soliciting client(s) and/or staff(s) affiliated with the Company. Distributing marketing materials for instance business cards, flyers but not limited to the aforementioned materials and/or promoting their own services while using the studio. Consequences for Violation: The studio reserves the right to immediate termination of all rental privileges if any of the above terms are violated, with no refund. Cancellation Policy: - No extension of time for latecomers. - 24 hours before the booking slot without being charged. - Late cancellations and no shows will be charged in full, and there will be no refund. Studio Rules: Safety & Security: - Grip socks are compulsory when you are using the equipment. - No outsiders or any third parties shall be allowed to enter the Studio space. Damage: - The Tenant assumes full responsibility for any damage caused to any part of the Studio sustained during the Tenant's scheduled rental period. The Tenant agrees to pay in full for repairing and/or replacing any items and/or props damaged by the Tenant or by teaching bodies, and/or guests invited to the Studio. - Our Studio reserves all rights against any unauthorised trespassers or any damage caused to the equipment. Housekeeping: - The Tenant assumes responsibility for returning the Studio and the equipment to the original state before they leave. - All lights, air-conditioner(s) and electrical equipment must be turned off. Trash and rubbish must be removed from the Studio. Risk and Waiver of Liability In consideration of being permitted to rent the Studio for the purpose chosen above, the Tenant assumes liability for injuries to any teaching bodies and/or guest(s) and/or person(s) they invite to the Studio during the rental period. The Tenant knowingly, voluntarily and expressly, agrees to discharge the Company from any and all Claims that the Tenant may have and the Tenant agrees to indemnify and hold the Company harmless in respect of any Liability or Loss.
